1. Scope of the Privacy and Cookies Policy

The data controller of the services available at www.bizky.pl within the meaning of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: “GDPR”) is BeChange sp. z o.o. with its registered office in Warsaw, Al. Ks. Poniatowskiego 1, Staircase K4, Level 1), 03-901 Warszawa, entered to the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number: 0000312229, NIP: 7010150265 (hereinafter “Bizky”, “we” or “us”).
We are committed to acting appropriately with regard to the collection, use and protection of personal data. We want you to be confident that your data is safe with us and also fully understand how we use it to offer you a better and more personalised service. It is for this reason that this Privacy and Cookies Policy (“Policy”) has been developed, which:

  • specifies the types of personal data (any information by which a person can be directly or indirectly identified – for example, e-mail address, telephone number, company name and legal form of business, REGON number, NIP number, PESEL number, website address) that we collect;
  • explains how and why we collect and use your personal data;
  • explains when and why we will share your personal data with other organisations;
  • explains the rights and choices you have when it comes to your personal data.

The purpose of this Policy is to inform individuals and Users visiting the Platform of the activities undertaken by Bizky with regard to the processing of personal data, including the data collected through the Bizky Service, as well as the related services and tools used by Users to use the Bizky Service, including, but not limited to, Registration, browsing the Service, placing Orders, using the Services in the Service or subscribing to the Newsletter. Every action of Bizky is governed by the relevant data protection legislation.

You may only use the Bizky Service if you have read and accepted this Privacy Policy when registering as a User of the Platform Services.
In relation to the range of services offered, we want you to understand clearly what this Policy covers.
This Policy applies to you if you use our services (referred to in this Policy as “our Services” or “the Services”). The use of our Services means:

Opening an Account in the Bizky Service and using the Services within the Service;

This Policy also applies if you contact us or we contact you about our Services regarding:
a) To process orders To enable communication between Users;
b) Settlement of accounts between Users;
c) Conclusion of agreements between Users and between Users and the Bizky Service;
d) Provision of other services as specified in the Regulations.

Our Bizky Service may contain links to other websites operated by other entities that have their own privacy policies and rules that explain how they use your personal data. In such situations, please read the said terms and conditions and privacy policies carefully before providing any personal information on such a website, as we do not accept any responsibility for third-party websites.

2. Personal data we collect

This section contains information about the personal data we may collect from you when you use our Services and other personal data we may receive from other sources.

When you register for and use our Services in the Service, you may provide us with the following Account and profile data:

  • Your personal data, including postal address, e-mail address, telephone number, date of birth, PESEL number, bank account number;
  • Your account login details, such as the username and password you have chosen; Information about the competent tax office, the type of User (self-employed/employed under civil law contract), website address, company name and type and form of business activity
  • It is also worth bearing in mind that the Accounts that exist within the framework of the created profiles are also used for contact, e.g. to establish cooperation between the Freelancer and the Principal.
  • Each User is obliged to provide the mandatory information required to register an Account in order to use the Platform. Users may voluntarily make their own personal data or other information available on public profiles (to which Internet users have access) on the basis of a free decision to make such information public, with appropriate consideration.

By browsing the Bizky Service we can collect:

  • Information about how you browse our Platform and information about when you click on one of our advertisements (including on the websites of other organisations);
  • Information about any devices used to access our Services (including make, model and operating system, IP address, browser type and mobile device identifiers);

When providing Service to Users or when we contact you or when you take part in surveys or questionnaires about our Services, we may collect:

  • Personal data that you provide about yourself whenever you contact us about our Services (for example, your first and last name, username, contact details, login), including by telephone, e-mail or post or when communicating with us via social media, including in relation to the fulfilment of your request or the response to your complaints, with the proviso that contact for the above purposes will also be possible through the use of data already in your Account.
  • Details of the e-mails and other digital messages we send to you, along with any links you click on;
  • Your opinion and contribution to User satisfaction surveys, but only with your consent for the purpose of researching your preferences and better adapting Bizky’s offer to your expectations, as well as for statistical and archival purposes.

3. Other sources of personal data

We may also use personal data from other sources such as: specialist companies that provide information, our business partners and public registers. This type of personal data helps us, among other things:

  • to review and improve the accuracy of the data we hold;
  • to improve and measure the effectiveness of our marketing communications, including on-line advertising.

In order to detect and prevent fraud and other crimes, it is important that we monitor our Services with a view to detecting and preventing fraud, other crimes and misuse of the Services. This will help us to ensure that you can use our Services securely.

We also monitor the performance of Users on the Bizky Service covering, among other things, keyword searches and traffic management on the Platform. Conducting potential litigation, arbitration or mediation proceedings.

5. Our legally justified purposes in using your personal datah

Bizky is entitled to store the aforementioned personal data that is collected and tracked on the Platform only for the purpose of fulfilling the purposes mentioned in the preceding paragraph, as well as not to use the aforementioned personal data for other, incompatible purposes, provided that the User has given their informed consent to the further use of the aforementioned data after Bizky has notified them thereof. The Platform may share personal data, including the User’s e-mail address and address data, with other Users if this is justified by the acceleration of the collection of the correct data needed for billing documents and contracts.
Where we have mentioned above that the use of personal data is based on our “legally justified purpose”, those are:

  • serving the needs of our clients, including the delivery of our Services;
  • promoting and marketing our Services;
  • handling the Account, management of complaints and resolution of any disputes;
  • understanding our Users, including their habits and behaviour, as well as their liking and
    preferences;
  • protecting and supporting our business, colleagues, users and co-owners;
  • testing and developing new Services and improving existing ones;
  • legal / regulatory requirements.

6. How and why we share personal data with service providers

In this section, we explain how and why we share personal data with service providers, such as electronic payment operators. When we share personal data with such companies, we require them to maintain security and they must not use personal data for their own marketing purposes.

Service providers

We work with carefully selected service providers who perform specific functions on our behalf. Those include, for example, companies that help us to provide: client services, technology services, storing and linking data, processing payments and delivering orders. We only share personal data that enables our providers to provide those services.

Some of the service providers we work with operate on-line media channels within which they place advertisements relevant to our services and also for our providers. For example, you may see an advertisement for our services when you use a certain social media site or watch web TV.

7. How and why we share personal data with other entities

We may share personal data with other organisations or Users in the following circumstances:

  • when the law or a public authority claims that we must share personal data, e.g. this is required by the tax office, law enforcement authorities or a general or administrative court;
  • where we need to share personal data in order to establish, exercise or defend our rights (including transferring personal data to others for fraud prevention and credit risk mitigation);
  • withorganisationstowhichwesellortransfer(orenterintonegotiationstosellortransfer)anyof our rights or obligations under any contract we may have with you. If the transfer or sale is successful, the entity receiving your personal data may use your personal data in the same way as we do;
  • with any legal successors associated with our business;
  • Principals and Freelancers to whose activities the GDPR applies, once Bizky has obtained thepersonal data of the other party to the order in question, are obliged to comply with all obligations towards the Principal/Freelancer under the GDPR and other relevant legislation, including the exercise of their rights under the GDPR. Personal data obtained in this way may only be processed for the purpose of using Bizky’s services and may not be further processed for other incompatible purposes, except with the express consent of the User.

8. How we protect your personal data

We know how important it is to properly secure and manage personal data. This section presents a selection of the measures we have introduced. To ensure the security of your data we use computer security features such as:

  • restricting access only to employees who need it to perform their job duties;
  • we enforce physical, electronic and procedural safe guards relating to the collection, storage and disclosure of personal data;
  • physical access controls to our buildings and files;
  • firewalls and encryption of data during transmission using the Secure Sockets Layer (SSL) protocol.

However, although appropriate technical and organisational measures have been taken to protect personal data, we cannot guarantee the security of any personal data sent to us over the Internet.

The personal data we collect from you may be transferred to and stored at a destination outside the European Economic Area (“EEA”). It may also be processed by companies operating outside the EEA that work for us or for one of our service providers. If we do so, we ensure that your privacy rights are respected in accordance with this Policy. We will not keep your personal data for longer than we need to, which depends on several factors:

11. How we use cookies

This Cookie Policy explains how the Bizky Service uses these cookies and other technologies when you visit the www.bizky.ai Platform, as well as the purpose of this information and how you can manage its use.

Cookies are IT data – in particular, text files – that are placed by our Bizky Service on the User’s terminal device during each visit, which allows our websites to remember the User’s computer or device and serves several purposes. The Platform is the entity placing cookies on the terminal device of a User of the Bizky Service and accessing them. The Bizky Service server automatically records information sent by the User’s browser when viewing the website. Server logs may contain information such as the network request, IP address, browser type and language, date and time the request was sent. This information allows us to improve the quality of our Services by identifying and storing your preferences and tracking trends, such as the ways in which our Service is searched.

Cookies placed on the final device of a Bizky Service User may also be used by third parties to offer additional functionalities to users. The use of the above tools or widgets may result in the collection of cookies on users’ devices in order to facilitate the use of those services and to ensure that user interaction is displayed correctly on the Platform.

12. Your choice regarding cookies

Although most web browsers automatically allow cookies to be placed on your computer, you may choose not to receive cookies, thus remaining anonymous. In this case, please note that if you do not consent to the placement of cookies, you will not be able to make full use of all the features of the Service. In order to configure your device’s options for consenting to the storing of cookies and for determining the scope of cookies to be stored, the User can make changes to the settings of the Internet browser used (in most cases, this option can be found in the Tools or Preferences menu of the browser). 14.1. The right to have the data corrected
If you think we have inaccurate or missing information about you, let us know and we will correct it.


14.2. The right to object
General objection – we will review your objection to our use of your personal data. If your rights prevail over our interests in using your personal data, then at your request we will either restrict the processing (see section 14.3 below) or delete the data (see section 14.4 below).

Objection to direct marketing – if you make such an objection, we will stop using your personal data for direct marketing purposes. As a result of an objection to direct marketing, and in the event that we have no other legal basis for its use, the processing of your personal data will be stopped within 30 days.
