§ 1. GENERAL PROVISIONS

1. The AIP Foundation, headquartered at Al. Ks. Poniatowskiego 1, Staircase K4, Level 1, 03-901 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000199402, holding NIP 524-24-95-143 (hereinafter referred to as the “Organizer”), declares that it operates a practical entrepreneurship development assistance program named “Bizky Freelance Prime Program” (hereinafter referred to as the “Program” or “Bizky Program”).

3. This promotion named “New Year’s Promotion” is organized by the Organizer under the terms specified in the Promotion Regulations (hereinafter referred to as the “Promotion”) and concerns the reduction of the basic monthly fee for participation in the Bizky Program, upon meeting the conditions of the Promotion.
4. The assistance referred to in section 1 is provided based on the Bizky Program Regulations available at the link: https://bizky.ai/regulamin/
5. The Promotion will take place from 02.01.2024 at 00:00:00 to 31.01.2024 at 24:00:00.
6. The Promotion is conducted within the territory of the Republic of Poland. However, for individuals wishing to take advantage of the Promotion who are not Polish tax residents, the Organizer will decide on a case-by-case basis about the possibility of participating in the Promotion.
7. The Promotion is not a lottery within the meaning of the Act of November 19, 2009, on gambling (Journal of Laws of 2023, item 227, as amended).
8. The Promotion cannot be combined with other promotions offered by the Organizer and applies to the net amount, to which VAT at the applicable rate of 23% must be added.
9. The Promotion Regulations are available for inspection at the Organizer’s headquarters and on the website bizky.ai (hereinafter referred to as the “Website”).

§ 2. PARTICIPATION RULES

1. The Promotion participant may be a natural person with full legal capacity who has not yet entered into an agreement with the Organizer for participation in the Bizky Program (hereinafter referred to as the “Promotion Participant”). Individuals who, within the period specified in § 1 section 5 of the Promotion Regulations, submit a participation request via the form available on the website bizky.ai and express their willingness to join the Bizky Program can participate in the Promotion.
2. A person who has submitted the application referred to in § 2 section 1 of the Promotion Regulations and entered into the Agreement for participation in the Bizky Program will receive a discount, which is calculated based on the time of applying for the Promotion within the period specified in § 1 section 5 of the Promotion Regulations, for the Bizky Program carried out by the Organizer under the conditions specified in the Bizky Program Regulations available at the Organizer’s headquarters and on the Website at the link bizky.ai.
3. The discount referred to above, upon meeting the conditions of the Promotion, results in the reduction of the basic monthly fee for the Promotion Participant for participation in the Bizky Program to the amount of 249 PLN net, to which VAT at the applicable rate of 23% must be added, giving a final amount of 306.27 PLN (in words: three hundred six zlotys and twenty-seven groszy) gross (hereinafter referred to as the “Discount”).
4. The Organizer may decide to extend the duration of the Promotion by providing information on the Website.
5. The discount will be calculated for no longer than three months from the date of entering into the Agreement for participation in the Bizky Program, provided it is entered into within the period specified in § 1 section 5 of the Promotion Regulations.
6. An individual may participate in the Promotion only once.
7. The discount cannot be transferred by the Bizky Program participant to third parties, nor can it be offset by the Bizky Program participant against any claim or other receivable against Bizky. The discount is also not exchangeable for a cash equivalent.
8. The Organizer may decide in individual cases to grant the Discount despite the Promotion Participant not meeting all the requirements of the Promotion.
9. In accordance with the obligation under art. 4 sections 2, 3, 4, and 5 of the Act of May 9, 2014, on informing about the prices of goods and services (Journal of Laws of 2023, item 168, as amended), the Organizer informs that the lowest amount of the basic fee for participation in the Bizky Program from the last 30 days before the Promotion was introduced is 199 PLN (in words: one hundred ninety-nine zlotys and zero groszy) net, while the regular price is 399 PLN (in words: three hundred ninety-nine zlotys) net.

§ 3. COMPLAINTS

1. Complaints regarding the Promotion may be submitted in writing to the address provided in § 1 section 2 or in electronic form to the email address: start@bizky.ai
2. Complaints will be considered within no more than 14 days from the date of their delivery to the Organizer, and the complainant will be promptly notified of the Organizer’s position regarding the complaint.
3. The lack of a response from the Organizer within the period specified in section 2 will result in the complaint being accepted.
4. The Organizer is not responsible for obtaining and using the Discount in a manner inconsistent with these Promotion Regulations.

§ 4. PRIVACY POLICY

1. The Personal Data Administrator is the AIP Foundation, headquartered at Al. Ks. Poniatowskiego 1, Staircase K4, Level 1, 03-901 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000199402, holding NIP 524-24-95-143; mailing address: Al. Józefa Poniatowskiego 1, Warsaw, Staircase K4, Level 1 (hereinafter referred to as the “Administrator”). Contact details for the Data Protection Officer: rodo@bizky.ai
2. The personal data of the Promotion Participant will be processed only to the extent necessary to implement the provisions of the Promotion Regulations. Providing personal data is voluntary but necessary to fulfill the benefits arising from the Promotion Regulations.
3. Appropriate technical and organizational measures will be taken to protect against unauthorized or unlawful processing of personal data, as well as against accidental loss, destruction, or damage to personal data.
4. Personal data will not be stored longer than necessary and permissible under applicable law, particularly for the period required to achieve the purposes and arising from social security regulations, tax laws, and the civil code.
5. The Administrator will not subcontract the processing of personal data without your prior consent, except for carefully selected providers performing specific functions on behalf of the Administrator (e.g., companies assisting the Administrator in providing: customer services, technological services, data storage and integration, payment processing, and order delivery).
6. As a party to the agreement, you have the right to access your data and correct, rectify, and (to the extent provided by law) delete, restrict processing, and object to the processing.
7. If you become aware of unlawful processing of personal data, being a party to the Agreement, you also have the right to lodge a complaint with the supervisory authority responsible for data processing – the President of the Personal Data Protection Office, headquartered in Warsaw (PUODO).

§ 5. FINAL PROVISIONS

1. Participation in the Promotion means the Promotion Participant’s acceptance of the terms of the Promotion specified in the Promotion Regulations.
2. The rules for conducting the Promotion are exclusively determined by these Promotion Regulations. All promotional and advertising materials are for informational purposes only.
3. Matters not regulated by the Regulations are governed by the relevant provisions of the Act of April 23, 1964, Civil Code (Journal of Laws of 2023, item 1610, as amended) and other generally applicable laws, including the Consumer Rights Act.
4. Issues related to the rights and obligations of the Promotion Participant who has entered into an agreement to participate in the Bizky Program, including the detailed rules of participation in the Bizky Program, the right to withdraw from the agreement to participate in the Bizky Program, fees for additional services provided by the Organizer, or the method of paying the basic fee for participation in the Bizky Program, are specified in the Bizky Program Regulations available at https://bizky.ai/regulamin/
